FAQ: In what cases do apprenticeships use the new OTJ calculation definition?
Following the 22/23 rules and the associated changes to the minimum off the job hours, apprenticeships that start after 1 August 2022 will now use the the new OTJ calculation definitions. In some cases, apprenticeships still use the old calculation.

22/23 Change to Minimum off the job hours (ILR calculation)
The previous minimum off the job hours calculation was:
Minimum OtJ = (Planned duration in weeks - ((Planned duration in weeks / 52) * 5.6 weeks statutory leave)) * (working hours * 20%)
The New minimum off the job hours calculation is:
Minimum OtJ = (Planned duration in weeks - ((Planned duration in weeks / 52) * 5.6 weeks statutory leave)) * (6 hours * ((minimum of 30 or working hours) / 30))
Identifying whether the apprenticeship will use the new OtJ calculation definition
Assumptions
- Within a Programme's ILR, only aims that pertain to a specific standard will be recorded. Specifically all programme aims will have the same funding model, programme type and standard code.
- The above being true, each programme aim present will be an episode of learning that contributes to the apprenticeship as a whole.
- Due to rules around funding the same learning, there will not be any valid overlapping aims.
These assumptions reflect the supported use of our system, specifically each programme will have a separate programme.
All of the above being true, the system finds the latest of the learning start dates for all aims with aim type 1 and funding model 36 that are not excluded. The system then takes the earlier of the learning start date or the original learning start date on this programme aim. It is this date that must be greater than 31/07/2022 for the new minimum OtJ calculation to be applied.

Minimum OtJ = (Planned duration in weeks - ((Planned duration in weeks / 52) * 5.6 weeks statutory leave)) * (working hours * 20%)The New minimum off the job hours calculation is:
Minimum OtJ = (Planned duration in weeks - ((Planned duration in weeks / 52) * 5.6 weeks statutory leave)) * (6 hours * ((minimum of 30 or working hours) / 30))
Identifying whether the apprenticeship will use the new OtJ calculation definition
The calculation uses the the earlier of the Learning Start Date or the Original Learning Start Date from the ILR of the latest programme aim, to determine which calculation to use. It is this date that will be used to determine which calculation should be used.
If the start date is greater than or equal to 01/08/2022, then the new 6 hours per week calculation will be used, otherwise the older 20% calculation will be used.
